This photo was published in the United States without any copyright notice (front and back, see also original upload). The original source dates the publication to the 1960s, a fact supported by the aging of the photo and the stamp on the reverse, partially erased by the passage of time. Although the are no stamps announcing in what newspaper or magazine the photo appeared, it was first published in the United States as the credit corresponds to Globe Photos, based in New York. The general publication, category in which this photo is included, "occurs when by consent of the copyright owner, the original or tangible copies of a work are sold, leased, loaned, given away, or otherwise made available to the general public, or when an authorized offer is made to dispose of the work in any such manner even if a sale or other such disposition does not in fact occur", so the mere offer of the photo by Globe Photos for publishing was the first publication in legal terms, and an evidence that the picture was first published in the United States, argument supported by the 2000 edition of the United States Code, which establishes that "the offering to distribute copies or phonorecords to a group of persons for purposes of further distribution, public performance, or public display, constitutes publication". | ||
